BY SIGNING THIS CONTRACT, YOU ARE AGREEING WITH AND WILL ABIDE BY ALL TERMS AND CONDITIONS
I hereby confirm my reservation to the Oldenburg Stallion, RAVE REVIEW for the year______, if said stallion is alive, fit to breed and standing at In Flight Farm. I understand and accept the following terms. A veterinary certificate and current uterine culture showing the mare to be in sound breeding condition and free of infection is recommended and REQUIRED for live cover. All fees, charges and transportation costs due In Flight farm must be paid before delivery of live semen and/or live cover.
I understand my mare, ____________________________ , must be examined by a licensed veterinarian between 21 and 45 days after the last day inseminated and/or bred and In Flight Farm notified of her pregnancy status at that time, or all live foal guarantees are null and void. I understand that my mare should also be reexamined by a licensed veterinarian between 50 and 60 days after the last day inseminated and/or bred. I understand that my mares’ breeding certificate must be signed and returned to In Flight Farm at the end of the current breeding season.
1. The stud fee for Rave Review for the breeding season ending , is $ 950.00. A non-refundable booking fee of $250.00 must be returned with this contract. Booking fee is INCLUDED in the stud fee. If semen is being collected and shipped, it is the responsibility of the mare owner to contact the veterinarian with whom In Flight Farm uses to collect and ship semen and open up an account for which they are responsible for all charges incurred AFTER the 1st collection and shipment of semen, which is included in the intial stud fee.
2. If mare is not being live covered, In Flight Farm assumes responsibility only to deliver fresh, cooled semen in viable condition at the time of delivery to the mare owners’ farm or veterinary office. The fresh, cooled semen must be administered by a licensed veterinarian on the day of delivery, or In Flight Farm shall be considered to have fulfilled the contractual obligations and any guarantees in clauses #3 and #4 shall consequently not apply. At the end of the breeding season or when the mare is pronounced in foal, the mare identification form, complete with all breeding dates and veterinary signatures must be returned.
3. This contract guarantees a free return privilege for the same mare if the mare is examined by a licensed veterinarian and found to be barren at 60 days from the date of fresh semen service, or live cover. If after two full breeding seasons the mare does not conceive, the mare owner may substitute another mare. At the beginning of the third breeding season, a new booking fee shall be due.
4. Should the mare not produce a live foal that stands and sucks, the mare owner shall also be entitled to re-breed the mare. This guarantee shall apply only if In Flight Farm is notified by registered mail within 48 hours of the foal’s death. A statement of details by a licensed veterinarian must follow within 10 days or the guarantee becomes null and void.
5. The mare owner shall assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whether by death, disease, injury, infection or otherwise, and by any cause whatsoever, and therefore agrees to hold In Flight Farm/Dave and DeeDee Estes harmless for any and all damages associated therewith.
6. This contract shall not be assigned or transferred without express written agreement from In Flight Farm.
7. It is agreed that should Rave Review die, be sold by In Flight Farm, or become unfit for service before fulfilling this contract, or if mare named in this contract, dies or becomes unfit to bred, before being bred or inseminated, then this contract shall be terminated and the stud fee, minus the booking fee shall be refunded.
8. All inspection and registration fees are the responsibilty of the the mare/foal owner.
